DC Court: Obama violated law on Yucca Mountain Site

Ignoring laws has become a regular component of the Obama administration.  The U.S. Court of Appeals in D.C. has ruled that President Obama and his administration have violated the law by delaying licensing for the Yucca Mountain nuclear waste storage facility in Nevada.

Yucca_Mountain_waste_packagesThe Obama administration has gone on record to ignore or not implement laws it rejects. Additionally, the Obama Administration delays implementation of laws passed by congress and signed by the President.  The recent example is delaying certain components of Obamacare.

Here is the story via KSNV in Las Vegas

Circuit Judge Brett Kavanaugh, who sided with the petitioners, said the Nuclear Regulatory Commission “continued to violate the law” by stopping the licensing process.

President Obama had stopped funding for the project in 2010, leading to the suits.

“The underlying policy debate is not our concern,” Kavanaugh said in the ruling. “The policy is for Congress and the President to establish as they see fit in enacting statutes, and for the President and subordinate executive agencies (as well as relevant independent agencies such as the Nuclear Regulatory Commission) to implement within statutory boundaries.

“The President and federal agencies may not ignore statutory mandates or prohibitions merely because of policy disagreement with Congress.”

According to the petition, the case involves the Nuclear Waste Policy Act, which was passed by Congress and then signed by President Ronald Reagan in 1983. That law provides that the NRC “shall consider” the Department of Energy’s license application to store nuclear waste at Yucca Mountain and “shall issue a final decision approving or disapproving” the application within three years of its submission.
