Judge rules Proposition 8 gay marriage ban unconstitutional

The People spoke, a judge overturns, the people spoke again, a judge overturns again.  So is it, “we the people” or “we the Judges”

SAN DIEGO – A federal judge Wednesday ruled that Proposition 8, California’s voter-approved ban on same-sex marriage, is unconstitutional.

Chief U.S. District Judge Vaughn Walker published his decision on a court website.

Walker’s verdict comes in response to a lawsuit brought by two same-sex couples and the city of San Francisco that seeks to invalidate the law as an unlawful infringement on the civil rights of gay men and lesbians.

Proposition 8 outlawed gay marriages in California five months after the state Supreme Court legalized them. It passed with 52 percent of the vote in November 2008.
